Although the total amount of recovered funds is impressive, courts are not collecting money from agricultural enterprises as actively as from companies in other industries.
According to statistics, over the past three years, courts have recovered approximately 860 million rubles from agricultural enterprises. This represents the total amount of funds that, according to court decisions, such enterprises are obligated to pay in 1,400 arbitration cases.
The success rate of claims against agricultural companies is approximately 48%, slightly lower than the overall economic rate. However, experts note that the outcome of a case largely depends on the region in which the agricultural enterprise operates.
The highest recovery volumes across all categories of cases are in the Northwestern, Moscow, and Central Districts. Significant figures are also seen in the East Siberian and West Siberian Districts. At the same time, in the Ural, Volga-Vyatka, and Far Eastern Federal Districts, the volume of collections remains relatively low. Experts note that this is likely a regional characteristic, as similar trends are observed for all companies, not just agricultural enterprises.
At the same time, analysts note that the courts generally accommodate agricultural companies to varying degrees.
This is confirmed by the fact that the volume of collections from them is typically relatively small, and collection decisions are generally made less frequently than for companies in other sectors.
It should also be noted that dispute outcomes largely depend on external factors. For example, weather conditions, which directly impact harvest volumes, as well as market conditions, particularly the prevailing prices for agricultural products.
Therefore, it follows that courts carefully examine the matter and seek to understand the company’s current situation.
If they determine that the company is in a difficult situation, they often reduce the amount of compensation or even rule in its favor.
Experience shows that lawsuits against agricultural enterprise managers are most often related to ineffective asset management, financing of unprofitable projects, and breach of contractual obligations to counterparties.
However, successful recovery is not guaranteed, experts note.
If the company has objectively suffered from crop failure or low market prices for its products, the likelihood of recovering its losses becomes significantly less likely.
